NOTICE OF THE REGULAR MEETING OF THE

COW CREEK GROUNDWATER CONSERVATION DISTRICT

KENDALL COUNTY, TEXAS     


NOTICE is hereby given that the regular meeting of the Cow Creek Groundwater Conservation District will be held on Monday the 9th of February, 2026. The meeting will begin at 6:00 P.M. and will occur in the District Meeting Room located at 9 Toepperwein Road, Boerne, Texas, at which time the following will be discussed, and appropriate action taken, pursuant to Chapter 36, Water Code; and pursuant to V.T.C.A. Government Code Section 551, Open Meetings, including all subchapters and sections:

  6. Permit hearing, discussion and possible action on the following pending operating permit applications:
    1. The Applicant/Permittee, Dolgencorp of Texas, Inc. (Dollar General Store #24200) is requesting a One-Time Authorization for Operating Permit BW8983, located at 830 FM 289, Boerne, TX. The applicant/permittee is requesting a temporary (one-time use) authorization for the withdrawal of 45,000 gallons of water for irrigation purposes over an estimated period of five to six weeks.  The current permit allocates 131,400 gallons annually.
  7. Discussion and action relating to the GMA 9 joint planning process. The Board of Directors will provide direction to the General Manager regarding proposed desired future conditions, relevancy vs. non-relevancy of the aquifers in the District and other considerations under §36.108, Texas Water Code.
  8. Discussion and action on engaging the District’s hydrogeologic consultant, Advanced Groundwater Solutions, LLC, to perform a review of the Draft Southern Trinity Groundwater Availability Model. AGS will provide written comments to the TWDB by the end of the day, February 17th, 2026.
  9. District activities & subcommittee updates:
    1. Monthly report

      1. Pending enforcement issues
      2. Pending permit applications

  1. The District may take a brief recess during the course of the meeting, depending upon the length of the meeting.

At any time during the meeting and in compliance with the Texas Open Meetings Act, Chapter 551, Government Code, Vernon’s Texas Codes, Annotated, the Cow Creek Groundwater Conservation District Board may meet in executive session for consultation concerning attorney- client matters (§551. 071); deliberation regarding real property (§ 551.072); deliberation regarding prospective gift (§551.073); personnel matters (§551.074); and deliberation regarding security devices (§551.076).
