NOTICE OF THE REGULAR MEETING
OF THE COW CREEK GROUNDWATER
CONSERVATION DISTRICT KENDALL COUNTY, TEXAS
NOTICE is hereby given that the regular meeting, a public hearing, and an enforcement hearing of the Cow Creek Groundwater Conservation District will be held on Wednesday the 20th of March, 2024. The meeting will begin at 6:00 P.M. and will occur in the District Meeting Room located at 9 Toepperwein Road, Boerne, Texas, at which time the following will be discussed, and appropriate action taken, pursuant to Chapter 36, Water Code; and pursuant to V.T.C.A. Government Code Section 551, Open Meetings, including all subchapters and sections:

- Public Hearing – The District will receive public comment on the proposed amendments to the Rules of the District. The proposed amendments to the District’s Rules primarily affect, but are not limited to, Rules: 1.4: Action on Rules; 3.1: Existing Wells; 3.3: New Wells; 5.6: Reporting and Recordkeeping; and 8.3: Actions on Drilling and Operating Permits.
- Discussion and action on Rulemaking.
- Enforcement Hearing – Public Hearing on the Notice of Violation and Enforcement related to the City of Fair Oaks Ranch operating its groundwater Well No. W2760 without a permit issued by the District. Well no. W2760 is located at 205 Cibolo Ridge Trail (Jose Ramon Arocha Survey No. 171, Abstract No. 2 Kendall County, Cibolo Ridge Subdivision, Unit 1, Lot 4). Section 36.113 of the Texas Water Code mandates that the District require a permit for the operation of Well No. W2760 by the City of Fair Oaks Ranch. The City of Fair Oaks Ranch does not have a permit for its Well No. W2760, and is, therefore, in violation of Texas law and the District’s Rules, which are expressly authorized by Chapter 8838 of the Texas Special District Local Laws Code and Chapter 36 of the Texas Water Code.
- Discussion and possible action to assess a reasonable civil penalty against the City of Fair Oaks, pursuant to Section 36.102 of the Texas Water Code, for operating its Well No. W2760 without the requisite permit, which is located at 205 Cibolo Ridge Trail (Jose Ramon Arocha Survey No. 171, Abstract No. 2 Kendall County, Cibolo Ridge Subdivision, Unit 1, Lot 4).
- Discussion and action related to ordering the cancelation of the General Election for the District 2 and District 3 Director’s positions of the Cow Creek GCD Board. The incumbent Directors were unopposed.

- At any time during the meeting and in compliance with the Texas Open Meetings Act, Chapter 551, Government Code, Vernon’s Texas Codes, Annotated, the Cow Creek Groundwater Conservation District Board may meet in executive session for consultation concerning attorney- client matters (§551. 071); deliberation regarding real property (§ 551.072); deliberation regarding prospective gift (§551.073); personnel matters (§551.074); and deliberation regarding security devices (§551.076).
